Our website forms are provided through WPForms Lite. The information collected depends on the fields displayed in the form and anything you include in your message.

Our hosting and website systems may also record technical information, such as your IP address, browser type, pages requested and access times, for website operation, troubleshooting and security.

Please do not submit fingerprints, identity documents, passwords or other sensitive information through general website enquiry forms.

3. Why we use your information

We use personal information to:

  • Respond to enquiries and requests for demonstrations.
  • Understand your requirements and prepare proposals.
  • Provide requested services and support.
  • Maintain relevant correspondence and business records.
  • Operate, maintain and protect our website and business systems.
  • Meet applicable legal obligations and manage legal claims.

Depending on the circumstances, we process information to take steps towards an agreement with you, perform an agreement, comply with legal obligations, protect legitimate interests or act on your consent.

Providing information through an enquiry is voluntary. However, without sufficient contact details or information about your request, we may be unable to respond or assist you.

Submitting an enquiry does not, by itself, constitute consent to receive unrelated marketing communications.

4. Who may receive your information

Personal information may be accessed by authorised Flexyware personnel and service providers where reasonably necessary to respond to your request, provide services or operate our systems.

We use xneelo for website hosting and Google Workspace for business email. Relevant information may be processed through these services and through the website tools used to receive and manage enquiries.

We may also disclose information where required by law or where lawfully necessary to investigate misuse, protect rights or manage legal proceedings.

5. International processing

Some service providers may process or store personal information outside South Africa.

Where information is transferred internationally, we must meet the applicable requirements of the Protection of Personal Information Act, 2013 (“POPIA”). These may include adequate protection under applicable laws or agreements, your consent, or another ground permitted by POPIA.

6. Cookies and technical information

Cookies are small files stored on your device by a website. Website software and hosting services may use cookies or similar technologies to support functionality and security.

Authorised website administrators may receive cookies associated with signing in and managing the website. We do not offer public visitor account registration or blog comments.

You can manage, restrict or delete cookies through your browser settings. Restricting cookies may affect some website functions.

Where optional analytics or tracking technologies are used, the relevant information and choices should be provided before those technologies operate, where required by applicable law.

7. Social media and external websites

Our website includes links to external services, including YouTube, Facebook and LinkedIn.

When you follow an external link, the destination service may collect information under its own privacy policy. Its handling of personal information is outside Flexyware’s control.

Our social media links allow you to visit or follow our pages. They should not be interpreted as requiring you to create an account with those services to contact Flexyware.

8. How long we retain information

We retain personal information for as long as reasonably necessary for the purpose for which it was collected.

Relevant considerations include whether an enquiry remains active, whether we provide services to you, applicable business record requirements, legal obligations and the need to resolve disputes.

When information is no longer required and there is no lawful reason to retain it, we will take reasonable steps to delete or de-identify it. Copies in backups may remain until those backups are replaced under the applicable backup cycle.

9. How we protect information

We take reasonable technical and organisational measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

Access should be limited to people and service providers who need the information for an authorised purpose.

No internet transmission or electronic storage system can be guaranteed completely secure. Where a security compromise occurs, we will take the steps required by applicable law, including notification where required.

10. Your rights

Subject to applicable law, you may:

  • Ask whether we hold personal information about you.
  • Request access to your personal information.
  • Request correction of inaccurate or incomplete information.
  • Request deletion of information where legally appropriate.
  • Object to processing on grounds recognised by law.
  • Withdraw consent where processing relies on consent.

Withdrawing consent does not affect processing that was lawful before withdrawal. Some information may need to be retained or processed
